Respecto a los Letrados destinatarios de este correo, se advierte de que se trata comunicación entre abogados, no pudiendo ser utilizada como prueba en ningún tipo de procedimiento, siendo expresamente aplicable el art. 22.3 del E.G.A. (RD 135/2021) y art. 5 del CÓDIGO DEONTOLÓGICO aprobado por el pleno del Consejo Gral. De la Abogacía Española 6 de marzo de 2019:"3. Cualquier tipo de comunicación entre profesionales de la Abogacía, recibida o remitida, está amparada por el secreto profesional, no pudiendo ser facilitada al cliente ni aportada a los Tribunales ni utilizada en cualquier otro ámbito, salvo autorización expresa del remitente y del destinatario, o, en su defecto, de la Junta de Gobierno, que podrá autorizarlo discrecionalmente, por causa grave y previa resolución motivada con audiencia de los interesados. En caso de sustitución, esta prohibición le estará impuesta al sustituto respecto de la correspondencia que el sustituido haya mantenido con otros profesionales de la Abogacía, requiriéndose la autorización de todos los que hayan intervenido. Se exceptúan de esta prohibición las comunicaciones en las que el remitente deje expresa constancia de que no están sujetas al secreto profesional.” “4. Las conversaciones mantenidas con los clientes o con los contrarios, de presencia o por cualquier medio telefónico o telemático, en que intervengan profesionales de la Abogacía no podrán ser grabadas sin previa advertencia y conformidad de todos los intervinientes y siempre quedarán amparadas por el secreto profesional.”

With regard to the lawyers to whom this e-mail is addressed, we warn that it is a communication between lawyers and cannot be used as evidence in any type of procedure, being expressly applicable art. 22.3 of the E.G.A. (RD 135/2021) and art. 5 of the DEONTOLOGICAL CODE approved by the plenary session of the General Council of Spanish Lawyers on 6th March 2019: "3. Any form of communication between legal practitioners, whether received or sent, is protected by professional secrecy and may not be disclosed to the client, nor submitted to the courts, nor used in any other context, unless expressly authorized by the sender and the recipient, or, failing that, by the Governing Board, which may authorize such disclosure at its discretion, on serious grounds and following a reasoned decision after hearing the parties concerned. In the event of substitution, this prohibition shall apply to the substitute in respect of the correspondence that the substituted lawyer has maintained with other members of the legal profession, requiring the authorization of all those who have been involved. Exceptions to this prohibition are communications in which the sender expressly states that they are not subject to professional secrecy.” “ 4. Conversations held with clients or opposing parties, whether in person or by any telephone or electronic means, in which legal practitioners are involved, may not be recorded without prior warning and the consent of all participants and shall always be protected by professional secrecy.”
